PUBLIC OFFER AGREEMENT
1. General Provisions
The administration of the website iguana-smoke.com (hereinafter referred to as the Site Administration), guided by Articles 633 and 641 of the Civil Code of Ukraine, addresses this public offer (Offer) to an unlimited number of individuals to conclude a website usage agreement under the terms set out below. This Agreement is public, meaning its terms are the same for all users, and full and unconditional acceptance of these terms is considered acceptance (approval) of the Offer. This Agreement has legal force in accordance with Articles 633, 641, 642 of the Civil Code of Ukraine and is equivalent to an agreement signed by the Parties.
Site Administration and User: Any individual or legal entity that accesses the website iguana-smoke.com and uses its functionality (hereinafter referred to as the User) agrees to this Public Offer Agreement by doing so. The Agreement becomes effective from the moment it is published on the iguana-smoke.com website and remains in force until the Offer is revoked. The Offer is valid throughout Ukraine for all Users of the site.
2. Purpose and Status of the Website
The website iguana-smoke.com is a demonstration online resource created solely for experimentation with organic Google traffic and to showcase a sample assortment of products. The site is NOT an online store conducting real commercial activity — no actual sale of goods, order processing, or payment acceptance is carried out through this resource. All information published on the website (including descriptions, prices, and product images) is intended solely for testing and experimental purposes and is not aimed at making a profit or encouraging real purchases.
Copying products from another site: The products displayed on the iguana-smoke.com website are copies (replicas) of products from iguanasmoke.com. This copying was done purely for experimental purposes to study internet traffic. The presentation of these products on iguana-smoke.com does not constitute an offer for sale, advertisement, or indication of their availability in actual commerce. All mentioned names, images, and trademarks belong to their legal owners; the use of such information on the demonstration site is for informational purposes only. The Site Administration does not claim any commercial affiliation with the owners of the original website or products.
Non-commercial nature: The site does not engage in business activities or provide paid services. No provision of this Agreement shall be interpreted as establishing a buyer-seller relationship or any other financial obligation between the Site Administration and the User. The User understands and agrees that consumer protection laws do not apply to their use of this site, as no paid goods or services are provided through the website.
3. Disclaimer of Warranties and Liability
All content and functionality of the site are provided on an “as is” and “as available” basis, without any express or implied warranties from the Administration. The Site Administration disclaims any representations or implied warranties and assumes no liability for the website, its content, or its use by Users. As the site is intended solely for demonstration, the accuracy, completeness, and relevance of the information are not guaranteed. The Administration does not confirm that the information is accurate or current and is not liable for any errors or omissions in the content.
Limitation of Liability: Under no circumstances shall the Site Administration be liable to any party for any direct, indirect, special, incidental, or consequential damages arising from the use of information published on this site. The User assumes all risks associated with the use of the website's materials. The Site Administration also bears no responsibility for the content and reliability of information obtained from external sources linked on the site; the presence of such links does not imply endorsement or verification of such information by the Administration.
Disclaimer of obligations: The iguana-smoke.com resource does not guarantee that its operation will meet the User’s expectations. The Administration does not guarantee uninterrupted access, error-free operation, or data security. The Administration shall not be held legally or otherwise liable for any losses, lost profits, or other negative consequences that may arise from the use of the site and does not provide any warranties, direct or implied, regarding the suitability or availability of any content or product for a specific purpose. The User agrees to use the site voluntarily and at their own risk, understanding that the resource is experimental and for demonstration only.
4. Procedure for Offer Acceptance
This Agreement is concluded without signing a paper copy by the User joining its terms. Acceptance of this Offer is deemed to occur when the User performs actions that indicate acceptance. By accessing or continuing to use iguana-smoke.com, the individual confirms their full agreement with all terms of this Agreement and undertakes to comply with them. If a person disagrees with any provision of this Offer, they must immediately stop using the site.
The moment of full and unconditional acceptance of the Offer is the start of the User’s interaction with the site, including viewing pages, clicking links, or other actions indicating use. From this moment, the Public Offer Agreement is considered concluded between the Site Administration and the User in accordance with Article 642 of the Civil Code of Ukraine. Unconditional acceptance of this Offer implies that the User fully understands each clause, acknowledges the legal consequences of such agreement, and confirms their legal capacity to enter into this Agreement.
5. Changes and Termination of the Offer
The Site Administration has the right to modify or supplement this Offer at any time unilaterally, without special notice to the User. Any changes to the Offer become effective upon publication of the updated version on the iguana-smoke.com website, unless a different effective date is specified. Users are advised to review the current version of the Offer regularly. Continued use of the site after changes are made constitutes the User’s automatic agreement to and acceptance of the new terms.
The Site Administration also reserves the right to revoke this Offer in whole or in part or to terminate the website iguana-smoke.com at any time at its sole discretion and without prior notice. Upon revocation of the Offer or termination of the site’s operation, this Agreement is considered automatically terminated and no longer in effect.
6. Final Provisions
This Public Offer and the relationship between the User and the Site Administration are governed by the current laws of Ukraine. Any disputes arising from the execution or non-execution of this Agreement shall be resolved through negotiations, and if an agreement is not reached — in accordance with Ukrainian legislation. The User agrees that all potential disputes shall be considered under Ukrainian jurisdiction and laws, and nothing in this Agreement shall be interpreted otherwise.
If any provision of this Offer is declared invalid or unenforceable, it does not affect the validity of the remaining provisions. An integral part of this Offer is the Privacy Policy (if available), which governs the processing and protection of personal data.
